Stutman usually defines what the parties agree is confidential—such as financial information; shopping habits; photos and videos of the spouse, the spouse's relatives and the couple's children; the status of the relationship—and provides that neither spouse shall publish it through social media or other means.

Specific forms of social media might be identified after the words "including but not limited to," ensuring that new forms that develop during the course of the marriage will be covered by the agreement.
