White Collar Criminal and Regulatory Defense

James J. McGuire leads this practice and has tried more than 25 cases to juries across a wide range of issues and argued over 20 appeals in the federal and state appellate court. Our attorneys draw upon extensive experience dealing with criminal and regulatory authorities including the SEC and IRS. 

We represent clients in a wide range of criminal and regulatory actions, including those concerning the securities and tax laws, FCPA, Bank Secrecy Act, federal False Claims Act, and export controls, as well as the more general criminal law.  We act at every stage of the criminal and investigative process, from before the initial investigation through trial and appeal.

A particular expertise is the area of extradition related to both individuals arrested in the US in connection to criminal proceedings overseas, and individuals arrested overseas in connection to criminal proceedings in the US. Of particular note was the Second Circuit’s decision in Sacirbey v. Guccione in 2009, in which the Court ruled that former Bosnian Ambassador to the UN, Muhamed Sacirbey, could not be extradited on mere accusations that he misappropriated government money while working in New York.

Key representations of our attorneys include:

  • SEC v. Kamshad, our attorneys represented a senior investment manager in connection with an enforcement action by the SEC alleging ‘market timing’. We negotiated, on the eve of trial, the most favorable settlement among the then-numerous market timing cases.
  • Full criminal acquittal on Commonwealth v. Quirk in state prosecution for alleged tax fraud and other wrongdoing.
